1. Our Commitment to Your Privacy

340B Auditor LLC ("340B Auditor," "we," "our," or "us") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect through our website at www.340bauditor.com (the "Site"), how we use it, who we share it with, and the choices available to you.

We handle personal information in accordance with applicable United States federal and state privacy laws.

By using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

2. Important Notice Regarding Protected Health Information

This Privacy Policy applies only to information collected through the Site.

It does not apply to protected health information ("PHI") or other confidential client data that 340B Auditor receives in the course of providing audit, consulting, or compliance services. That information is governed by our written agreements with each client, including any applicable Business Associate Agreements, and by the Health Insurance Portability and Accountability Act ("HIPAA") and its implementing regulations.

Please do not submit PHI, patient records, claims data, or other sensitive health information through the Site, through our contact forms, or by unencrypted email. If you need to transmit that type of information, contact us directly and we will arrange a secure method.

3. Information We Collect

Information you provide to us. When you complete a form on the Site, subscribe to updates, or contact us by email, we may collect your name, organization, job title, email address, telephone number, entity type, and the contents of your message.

Information collected automatically. When you visit the Site, our servers and service providers may automatically collect certain technical information, including your IP address, browser type and version, device type, operating system, referring website, pages viewed, links clicked, and the dates and times of your visits. Some of this information is collected through the analytics and preference technologies described in Section 6.

We do not knowingly collect Social Security numbers, financial account numbers, or health information through the Site.

Impact Profile Builder. Information entered in the builder stays in the open browser page and is not submitted to 340B Auditor. The builder does not send analytics events or save profile entries in browser storage. Closing or reloading the page discards unsaved entries. You can save a profile data file or download a report to your device; those files may contain sensitive organizational information. Use aggregate information and do not enter patient identifiers. The hosting provider still receives the ordinary request to load the page.

4. How We Use Information

We use the information we collect to:

  • Respond to your inquiries and provide the services you request
  • Communicate with you about engagements, proposals, and scheduling
  • Send updates and program information you have requested
  • Operate, maintain, secure, and improve the Site
  • Analyze usage patterns and measure the effectiveness of our content
  • Comply with legal obligations and enforce our agreements
  • Protect against fraud, unauthorized access, and other misuse

5. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

We may share information in the following limited circumstances:

Service providers. We use third-party vendors to host the Site, deliver email, process form submissions, and provide analytics. These vendors may access personal information only as needed to perform services for us and are contractually obligated to protect it.

Legal and safety. We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate suspected fraud.

Business transfers. If 340B Auditor is involved in a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a materially different privacy policy.

With your consent. We may share information for any other purpose disclosed to you at the time you provide it.

6. Cookies and Similar Technologies

The Site does not set cookies. We use the following technologies, which are similar to cookies in how they operate:

Analytics. Usage analytics is currently disabled. If enabled in the future, Plausible Analytics will send usage events only after you select Accept in the analytics notice. It does not use cookies or track visitors across websites. Its handling of request data is described at plausible.io/data-policy.

Stored preferences. When you make a choice in the notice, we record that choice in your browser’s local storage so that we do not ask you again. This stores only your selection and no other information.

You can check the current analytics setting or change an available choice by selecting "Analytics preferences" in the footer of the Site. Declining does not affect how the Site works.

Opt-out preference signals. We honor recognized opt-out preference signals, including Global Privacy Control (GPC) and Do Not Track. If your browser sends either signal, we treat it as a decline: analytics does not load and the notice is not shown.

7. Your Privacy Rights

Depending on your state of residence, you may have the following rights regarding your personal information:

  • The right to know what personal information we collect, use, and disclose
  • The right to access a copy of your personal information
  • The right to correct inaccurate personal information
  • The right to request deletion of your personal information
  • The right to data portability
  • The right to opt out of the sale or sharing of personal information and of targeted advertising. Note that we do not sell or share personal information
  • The right to appeal a denial of a privacy request
  • The right not to receive discriminatory treatment for exercising these rights

We will take steps to verify your identity before responding and will respond within the timeframes required by applicable law. You may designate an authorized agent to submit a request on your behalf.

California residents. In addition to the rights above, California residents may request information regarding our disclosure of personal information to third parties for their direct marketing purposes under California’s "Shine the Light" law.

8. Email Communications

If you subscribe to updates from 340B Auditor, you may unsubscribe at any time using the link included in any email or by contacting us directly. We may continue to send transactional and service-related messages regarding active engagements.

9. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

10. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with our legal, tax, and professional recordkeeping obligations, to resolve disputes, and to enforce our agreements.

11. Third-Party Links

The Site may contain links to third-party websites, including social media platforms. We are not responsible for the privacy practices or content of those websites. We encourage you to review the privacy policy of any site you visit.

12. Children’s Privacy

The Site is intended for a business audience and is not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above. Material changes will be posted prominently on the Site. Your continued use of the Site after the changes take effect constitutes acceptance of the revised policy.
